TERMS AND CONDITIONS OF SALE

1. APPLICATION OF CONDITIONS All herbs and related products sold by Herbs of Grace (“We”, “Us”, “Herbs of Grace”) and are subject to the following terms and conditions unless otherwise clearly stated in writing under a separate contract.

2. PRICE LIST AND SALES LITERATURE The prices given in our product list, sales literature and web site are for information purposes only and do not represent an offer. No contract will come into existence until the customer’s order (however given) is accepted. Invoices will be raised for prices current at the time of order.

3. CARRIAGE Except as otherwise stated, all prices given are on an ex-works basis and exclude transport and delivery costs.

4. DELIVERY Any dates quoted for delivery are approximate only. Every endeavour will be made to ensure and affect delivery on agreed dates based on information available at time of order. We will accept no responsibility for any loss resulting from delivery delays.

5. PAYMENT For non-account holders, payment is required in cleared funds before despatch. For account customers, payment is strictly due within 30 days of receipt of order. Web based orders will not be dispatched until funds have been cleared. This includes credit card payments and cheques.

6. OWNERSHIP OF GOODS Goods remain the property of Herbs of Grace until paid for in full.

7. DAMAGED GOODS AND SHORT ORDERS Any claim that goods are damaged, are not of the correct quantity, or do not comply with their description, must be notified by the customer to Herbs of Grace in writing within 3 days of their delivery.

8. STORAGE Herbs of Grace will be under no liability for any defect in the goods arising from incorrect storage by the customer. They should be kept in air-tight opaque containers in a cool place out of direct sunlight. If cared for correctly, herbs will remain active for long periods.

9. QUALITY Every effort is made to ensure the goods supplied are of the finest quality and in good condition. If the customer is not fully satisfied with the product then, with reasonable notice, Herbs of Grace will exchange or refund the customer fully up to three months from invoice date. The statutory rights of the customer are not affected by these conditions.

10. SEASONAL SHORTAGES AND OUT OF STOCKS Every effort is made to ensure all products listed in our promotional material are in stock, but please note that some herbs are subject to seasonal shortages. We do not accept any responsibility for loss resulting from any out of stock items.

11. PRODUCT SUITABILITY Herbs of Grace products are used for a wide variety of purposes. It is the absolute responsibility of the customer and consumer to ensure that the products are appropriately used. All representations, warranties, conditions or terms relating to fitness for purpose, are excluded to the fullest extent permitted by law and Herbs of Grace accepts no liability.
